Furthermore the following requirements will be expected:

3. True Copy of the Marriage contract of the alien and the Filipino spouse

4. Certificate of Legal Capacity to Contract Marriage, issued by the Embassy or the Consulate  of the alien spouse (if marriage in the Philippines), OR official family register with authentic interpretation as certified by the Philippine Embassy of Consulate in the alien’s home and country (if marriage has been solemnized there)

5. Joint Affidavit of legal capacity to contract marriage, stating any previous marriage(s) and the manner by which the marriage was dissolved

6. If alien spouse was previously married, a true copy of the divorce decree dissolution of marriage or death certificate, as the case may be, duly authenticated

7. True copy of birth certificate of minor unmarried children under 21 years, if any

8. Joint Affidavit of Financial Capacity and support executed by the applicant and the alien spouse with supporting documents (bank statements, land titles, income, pension) showing capacity to support themselves

9. Medical Certificate from the Bureau of Quaratine that alien spouse and unmarried children are not afflicted with any contegious, dangerous and loathsome disease

10. Separate AIDS certification from selected hospitals

11. Clearance from the central government agency of applicant’s country or place of residence, on any criminal record the applicant may have, duly authenticated by the Philippine Embassy or Consulate in or closest to the applicant’s country

12. Philippine NBI clearance

13. Bureau of Immigration Clearance

14. Copy of passport of alien spouse and children showing date of arrivals and validity of stay.

All documents NOT in English language must be translated by authorized and certified translator.

If the wife (or husband) of alien applicant was former Philippine citizen, he/she has to prepare a Letter of Application for change status to returning former Filipino citizen (Section 13, para G, P.I.A., as amended). Additional requirements are:

1. General application form duly accomplished AND notarized

2. 2 x 2 ID pictures to be attached to the application form

3. Birth certificate of applicant (NSO!)

4. Certificate of naturalization in a foreign country (eventually with translation!)

5. Medical certification from the Bureau of Quarantine stating that the alien (former Filipino) is not afflicted  with any dangerous, contagious or loathsome disease

6. Attach photocopy of passport

7. Affidavit stating that the applicant intends to reside permanently in the Philippines with proof of financial capacity.

If spouse and minor unmarried children shall join the applicant, the following requirements are requested:

1. Certified true copy of marriage contract of applicant and spouse

2. Birth Certificate of minor unmarried children

3. Affidavit of Support of guaranty by the applicant

4. Copies of their respective passports.

    Hi Zois, thanks for your compliments. That’s very difficult to say. if you are lucky and met a wonderful Filipina woman and marry her, you might apply for a permanent residence visa thru marriage. If you are not lucky (like me 25 years ago!), you should try a business visa or a SRRV (special retirement visa). My advices are very superficial, because it’s hard to say, what would be the best for you or anybody else.

    Hi Zois, thanks for stopping by again. In your case I would suggest to apply for a Non Quota Immigrant thru marriage (Section 13 para G, Philippine Immigration Act). Follow the explanations and steps as I wrote). Good luck again!

    attorney with YOUR approved documents: income, pensions, savings etc. There is no maximum or minimum of proof of financial capacity. The more - the better. Can you submit land litle, regular income, savings etc.??

    Vincent, I don’t know, how long it wil take re Bureau of Quarantine. My wife will accompany you and all applicants, if you apply here in Davao City, to all doctors and examinations. After this you might be able to compete your BI requirements. The seperate AIDS clarification can be done in Davao. Re nr. 11; both of you. (Meanwhile the checklist of requirements has been changed again!). Re Nr. 11 and 12; it’s both of you.

    Hi again Klaus; I have heard on the grapevine that as long as the t’s are crossed and the i’s dotted there is not much of a problem with Philippines Immigration when it comes to letting Kano spouses have residency because they figure if we run out of money we will go home and get more. For example I have heard of Kano husbands with very humble tax statements having no trouble getting residency here because, basically a very humble income in the USA or elsewhere is a big income here. We are not going to compete with Filipino’s for jobs when a cleaner at home makes what a senior politician makes here.

    Hi Chris, yep, you are right. Of course, you are very welcome here in the Philippines if your “financial proof has been successful”. Of course, not everybody can run home and get more. For those (including me) other measurements count. Doing some business here in the Philippines or being allowed to teach the German language like in my case (you see, it’s not a competition with any other Filipino teacher or professor) AND maybe receiving a monthly pension - and no Philippine authority will “send you home”… .
