My (personal) legal battles and experiences

I love the Philippines. I was the one, who decided to move here to the Philippines for good even long time before reaching my pensioner age. I will turn to 55 this coming month. My wife Rose will be celebrating her 50th birthday this coming October. My mother is looking forward her 85th birthday also this coming August. My family is living with us in one compound… .

When I was still editing law magazines in Berlin/Germany during my last professional years in a publishing house, many times I thought (while proof reading): “I will do everything, THAT THIS WILL NEVER HAPPEN TO ME AND MY FAMILY!”.

Yes, I am blessed to have such an outstanding wife and her family with me. If not, to be honest: I would surrender. Even being an “upstanding ex pat”, knowing this country this 1976 (!), I have to experience (and survive!) some personal legal battles (and HELPFUL?) experiences HOW TO SURVIVE IN THE PHILIPPINES, even being known,  —- even having very valuable connections to VIP’s, even, even… .

Check out Bob Martin’s post tomorrow regarding my very personal problem. It might help you to ’survive’ your own (similar?) or (coming soon?) problems. And,  —- expect my very own personal comments. Yes, I am a Journalist. I don’t care any threads. I love to tell the truths.

I got a lot of support from the Davao City government.

I apologize to you all bearing my very personal problem.

“Stay tune” - and try to learn from the experiences from an ex pat, “who still love the Philippines”. … No matter, what happens… .

I read your story in sunstar.com.ph, I am so sorry what happen to you and your family. It happens to my family, I think the reason behind it, is jealousy. May you have strength in this difficult time.

hi klaus - i wish you & your family the best of luck. from bob’s post, i was very much surprised & upset at what happened.

i do believe Ron W is right and that things will end up fine inevitably. i’m glad you are getting support from many & that a city councilor is now acting to help you.

Hi Angel, thanks for your kind words. It’s not only jealousy. It’s money. These are people, “who love to play such games”. Thank you for your prayer.

Hi Ron W., thank you too. Actually we have all evidences: We have a clean landtitle, which states 15 meters wide Public Road in front of the whole East line of our property. This road has been squattered and “legally titled”… We are fighting against this since 2 years. “The owners” changed almost every year. The “present owner” is a Chinese, whose ‘whereabouts’ are unknown…

Hi Macky, thank you also for your kind words. We hope everything will be fine, because after my mother-in-law was hit by a stroke, some other in-laws are getting sick too. I am indeed glad that City Councilor BRAGA is doing her very best to help. Our case has been already discussed in two council hearings.

So sorry to hear about what happened.
I hope you get access back soon.

This is so unfortunate that this would happen to you. How inconsiderate whoever applied for titling on your only road access. My prayers to you. Please be careful these kind people can sometimes be dangerous also. Did he post armed goons or professional uniformed armed security guards along the fence? The Phil. goverment is badly in need of funds and therefore if anybody applies for titling of public land it is almost always granted. Ofcourse they have to publish in a local paper for at least 2 weeks but who reads all the newspapers everyday.
For anyone who purchased a beachfront property. The foreshore and the adjacent public land can be applied for lease or titling by anyone.
Somebody might just decide to build a marina on that public land and foreshore and block your beach access. This has happened many times and usually by powerful persons.

Hi Cheryll Ann, thanks a lot for your concern. I am sure, with God’s help and a strong “government help” everything will be fine very soon.
Hi Bobby, salamat kaayo also for your kind words. Meanwhile we got all details and evidences “in favour of us”. Time will tell.- Btw: he posted three civilian armed guys. Of course nothing has been published in any daily newspaper. They also got the fencing permit by submitting wrong documents (maps etc.). The City Engineers signed without viewing… We are hopeful, because it’s already a case in the City Council. Thanks for mentioning a beachfront property. This is something I would never try to buy. I heard a lot of bad experiences as what you mentioned also.

Hi Maryg, thanks for your kind words and your concern. I am sure, everything will be fine. And, as many people told me by sending me emails:”Go on with your column and write!” Don’t worry, I will!!! Salamat and God bless.

I hope things will gonna be sort out for good..ASAP…

Just like everybody ..we will be here by your side…..

  12. Klaus on July 14th, 2008 3:26 pm

Hi Jocelyn Green, thank you for your concern and your heartily comment. Bad Karma? Yup, I also believe in such things. Life goes on - and it really goes on with people like you. Maraming salamat Jocelyn - God bless. I still embrace the Philippines and its people, because I know, the real Pinoy or Pinay is like you and many more millions…
